Finding a replacement tenant in Switzerland: List your apartment for free and leave your lease early
Tenants who want to leave before the ordinary termination date may be released early from their contractual obligations by proposing a suitable replacement tenant. Private individuals can list their apartment on UrbanHome free of charge and without registration, reach interested applicants and collect complete applications for the property manager. Solvency, suitability, acceptance of the existing terms and clear written evidence remain decisive.
At a glance
Article 264 of the Swiss Code of Obligations allows a rented home to be returned before the ordinary termination date. To end liability earlier, at least one solvent, suitable and willing replacement tenant must generally be proposed who is prepared to take over the existing contract under the same terms. Several applications are not required by law but are advisable in practice. Private individuals can list their apartment on UrbanHome free of charge and without registration and begin the replacement-tenant search immediately.[1][4]

Article 264 CO: How an early move-out works
A tenant who returns the apartment without observing the notice period or termination date generally remains liable until the next ordinary date. The statutory exception applies when a new person is proposed who is solvent and suitable and willing to take over the tenancy under the same terms.
Legally, this is often not an extraordinary termination but an early return of the rented property. Moving out or handing back the keys alone does not end the existing contract.
| Situation | Consequence for the departing tenant |
|---|---|
| Suitable replacement tenant takes over on the intended date | Obligations generally end on that date. |
| Suitable person is rejected without an objective reason | Obligations may still end on the possible takeover date. |
| Landlord wishes to renovate or use the apartment personally | If a suitable person was ready to take over, the departing tenant may still be released. |
| No suitable person is found | Rent generally remains due until the ordinary date or an earlier reletting. |
Do tenants really have to provide three replacement tenants?
No. The widespread “three-candidate rule” does not appear in the statute. One suitable person may be enough. The practical risk is that an application may be incomplete, solvency may be insufficient or the candidate may withdraw before the contract is concluded.
Why several applications are still advisable
- An applicant may change their mind after the viewing.
- The debt-enforcement register extract may contain unexpected entries.
- The desired move-in date may change.
- The manager may require additional property-specific evidence.
- In a shared flat, a candidate may not be personally compatible for objective reasons.
It is therefore sensible to collect several serious and complete applications. Quality remains more important than the number.
When is a replacement tenant suitable?
| Criterion | More likely suitable | Potentially problematic |
|---|---|---|
| Solvency | Traceable income or other secure funding and current credit documents. | Unclear funding, serious debt-enforcement entries or missing evidence. |
| Suitability | No objectively important reason for rejection; household size fits the property. | Objectively unsuitable occupancy or concrete major conflict risks. |
| Willingness to take over | Written confirmation for the intended date. | Only informal interest or a later start date. |
| Same terms | Rent, service charges, duration and other conditions are accepted. | Takeover only with a lower rent or other material changes. |
| Documents | Complete form and requested evidence. | Contradictory or incomplete information. |
The landlord should not impose stricter suitability requirements than for the existing tenant. In a shared flat, personal compatibility and the views of the remaining residents may carry more weight.
Why start the search on UrbanHome?
UrbanHome connects the legal need to find a replacement tenant with a direct listing option that is free for private individuals. Its official listing page expressly states that private listings are free and do not require registration. The page also states more than 300,000 visitors.[4]
Free for private individuals
According to UrbanHome, no listing fee is charged for a private apartment advertisement, so the search can begin without purchasing a package.
No registration
Private users can start without creating an account, reducing friction when the intended move-out date is close.
Dedicated replacement-tenant search
UrbanHome provides a dedicated page for a free replacement-tenant search aimed directly at tenants leaving early.[5]
Direct enquiries
The listing reaches people actively searching for rental homes. The final selection and credit assessment remain with the landlord.
How to create a persuasive replacement-tenant listing
A complete listing generates not only more enquiries but also a better chance of receiving suitable and complete applications. It should be specific, truthful and easy to scan.
Information to include
- municipality and neighbourhood,
- number of rooms, floor area and floor,
- net rent and service charges shown separately,
- earliest or intended start date,
- balcony, lift, storage, parking and ancillary rooms,
- public transport, shopping, schools and other location advantages,
- pet rules where known,
- viewing dates and application process,
- a note that the landlord makes the final decision.
Photographs that help
- Tidy the apartment and photograph it in daylight.
- Show each important room from an understandable angle.
- Include the balcony, view, kitchen, bathroom and storage.
- Do not show people, personal documents or valuables.
- Do not hide defects with filters or image editing.
Organising viewings efficiently
Several short viewing windows are usually more efficient than many individual appointments. Confirm rent, takeover date and important conditions beforehand so unsuitable enquiries can be filtered out early.
| Before the viewing | During the viewing | Afterwards |
|---|---|---|
| Confirm rent, date and key conditions. | Show the apartment factually and answer questions. | Send the application form and deadline. |
| Allocate applicants to time windows. | Do not ask discriminatory preliminary questions. | Forward only serious, complete applications. |
| Remove valuables and private documents. | Do not conceal defects. | Document consent to forwarding personal data. |
Which documents are useful, and what about data protection?
The property manager determines the documents needed for selection. Common examples include an application form, debt-enforcement register extract, proof of income, identity details and references. The departing tenant should collect no more personal data than necessary.
The Federal Data Protection and Information Commissioner requires applicant data to be processed lawfully, transparently, for a defined purpose, proportionately and securely. Only information directly connected with selection or conclusion of the tenancy should be requested.[6]
Privacy-friendly process
- Where possible, direct applicants to the property manager’s form.
- Forward documents only with the applicant’s consent.
- Do not send application files in open group emails.
- Delete documents securely after the procedure.
- Do not request unnecessary health, religion or family information.
- References should be contacted only with the applicant’s knowledge.
How to submit replacement tenants correctly
The submission should be written and traceable. The Tenants’ Association recommends sending the form, covering letter and, where possible, copies of debt-enforcement extracts by registered post and retaining copies and the postal receipt.
Sample covering letter
Subject: Early return of the apartment and submission of replacement tenants
Dear Sir or Madam
I intend to return the apartment at [address] early on [date]. Enclosed are the applications of interested persons who are willing to take over the existing tenancy from that date under the current terms.
Please assess the applications and confirm in writing the date on which I am released from my contractual obligations. If an applicant is rejected, please provide the reason in writing.
Yours faithfully
[Name]
Submit candidates early. Depending on the circumstances, assessment may take approximately 14 to 30 days. A written follow-up after roughly ten days is advisable.[2]
What if the candidate is rejected, rent is increased or plans change?
The landlord does not have to accept the proposed replacement tenant. If a suitable person is rejected, however, the departing tenant’s liability generally ends on the date that person would have taken over.
This may also apply where the landlord intends to occupy or renovate the apartment or demand a higher rent. Evidence that the proposed person genuinely intended to accept the existing contract and date is crucial.
Secure written evidence of
- the intended takeover date,
- willingness to take over under the same terms,
- the date the application was submitted,
- the complete application documents,
- any rejection or new terms imposed by the landlord.
What if nobody is found or a candidate withdraws?
Without a suitable replacement tenant, liability generally continues until the next ordinary termination date or an earlier reletting. In addition to notifying the early return, serve a formally valid ordinary notice for the next possible date as a precaution.
If a candidate withdraws
The decisive question is whether a binding and provable willingness to take over existed. A mere enquiry or viewing is insufficient. Several candidates and written confirmations reduce risk.
If the apartment is relet earlier
The landlord may not collect rent twice. Income from earlier reletting and expenses saved must be taken into account in any remaining claim.
Which costs may arise?
| Cost | Assessment |
|---|---|
| UrbanHome private listing | According to UrbanHome, free and without registration. |
| Debt-enforcement register extract | Usually obtained by the applicant. |
| Photographs or floor plan | Often possible without additional cost through your own preparation. |
| Extra processing fee from the manager | According to the Tenants’ Association, not owed solely because of the early return. |
| Overlapping rent because the search began late | The largest financial risk; early publication reduces it. |
The most common mistakes
- Publishing only a few days before the intended move-out.
- Leaving rent or takeover date unclear.
- Sending only names and phone numbers instead of complete applications.
- Assuming that three candidates are legally mandatory.
- Promising an applicant the apartment.
- Failing to document an oral acceptance or rejection.
- Forgetting ordinary notice as a fallback.
- Forwarding personal data insecurely or without consent.
- Handing back keys without written clarification of release and handover.
Step by step to a replacement tenant
- Check the tenancy, notice period and ordinary termination date.
- Set the intended return and takeover date.
- Notify the landlord of the early return in writing.
- Serve ordinary notice for the next possible date as a precaution.
- Prepare the apartment and take current photographs.
- List the apartment free of charge on UrbanHome.
- Hold viewings in manageable time windows.
- Explain rent, date and the same-contract requirement.
- Collect complete applications in compliance with data protection.
- Submit several suitable files traceably.
- Request written confirmation after approximately ten days.
- Document rejections and withdrawals.
- Have the release date and handover confirmed in writing.
Typical examples
Job change to another city
A tenant wants to leave six weeks early. She lists the apartment free on UrbanHome, holds two grouped viewings and submits four complete applications. The manager selects one person for the intended date.
Only one suitable applicant
One person is solvent, accepts the rent and wants to take over on the right date. Even without three candidates, this one suitable applicant may be sufficient.
Landlord increases the rent
The proposed person was willing to move in at the existing rent. They withdraw after a rent increase is announced. The departing tenant secures written evidence of the original willingness and requests release.
Applicant withdraws
The only interested person later decides not to move. With no other suitable application, liability continues. Several candidates would have reduced the risk.

One suitable person may be enough under Article 264 CO if they are solvent, suitable and willing to take over the existing contract on the intended date under the same terms. Several complete applications reduce the risk of withdrawal. Private individuals can list their apartment on UrbanHome free of charge and without registration.
